By accessing, browsing, registering for, or using the d33ply web application at d33ply.xyz (the "Platform" or "Service"), you agree to be bound by these Terms & Conditions (the "Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you may not use the Service.

Your use of the Platform constitutes a binding legal agreement between you and d33ply (operated by a legal entity registered in Leverano, Italy).

3. SERVICE DESCRIPTION

3.1 What We Offer

The Platform is a B2C SaaS web application that allows users to:

  • Browse AI-generated podcast episodes
  • Listen to audio files via streaming
  • Read transcripts and episode takeaways
  • Maintain a personalized listening history
  • Save favorite episodes and customized dashboard preferences
  • Access content from a global repository

3.2 Service Availability

We provide the Service on an "AS-IS" basis. While we aim for continuous availability, we do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control.

Scheduled Maintenance: We will attempt to notify users of planned downtime 24 hours in advance via email or in-app notification.

4. IMPORTANT: AI-GENERATED CONTENT DISCLAIMER

4.1 Content Nature

All podcast episodes published on the Platform are generated using Artificial Intelligence (AI). Specifically:

  • Audio content is synthesized using AI voice generation
  • Text content (scripts, summaries, takeaways) is generated using large language models
  • Every episode is based on real, cited sources which are provided to you for verification
  • The AI acts as a synthesizer and presenter, not a source of truth

4.2 Limitations & Disclaimer

By using the Platform, you acknowledge and agree:

  1. AI Content May Contain Inaccuracies: Despite our quality controls, AI models can produce false, misleading, or incomplete information. We cannot guarantee the factual accuracy of any episode.
  2. Verify Critical Information: For any critical, health-related, legal, financial, or important information, you must independently verify the content using the provided sources.
  3. No Professional Advice: The Platform does not provide professional advice. Episodes are entertainment and educational content only.
  4. Synthesized Voice Disclaimer: Audio content is computer-generated and synthetic. The synthesized voice is not a human speaker.
  5. We Are Not a Primary Source: We compile and present information from cited sources. Errors, bias, or misrepresentation may occur during synthesis.

5. USER ELIGIBILITY & ACCOUNT REQUIREMENTS

5.1 Age Requirement

You must be at least 18 years old to create an account and use the Service.

5.2 Account Registration & Responsibility

To use the Platform, you must create an account and provide accurate information. You are solely responsible for all activities under your account.

6. SUBSCRIPTION, BILLING & PAYMENT

  • Payment Processor: Stripe. We do NOT store your credit card information on our servers.
  • Currency: USD / EUR (based on location)
  • Automatic Renewal: Subscriptions renew automatically unless canceled.

7. CANCELLATION & REFUND POLICY

7.1 Cancellation

You may cancel your subscription at any time via "Settings" → "Subscription". Cancellation takes effect at the end of your current billing cycle.

7.3 Refund Policy

No Refunds: Subscription fees are non-refundable except as required by law.

EU Consumer Protection: Residents of the European Union have a 14-day right of withdrawal. Contact us at team@d33ply.xyz.

8. INTELLECTUAL PROPERTY RIGHTS

d33ply retains full ownership of the Platform, branding, and episode metadata.

AI-Generated Content Ownership: Episodes are created by d33ply and published for your personal, non-commercial use.

Source Attribution: All episodes cite original sources. These sources retain their own intellectual property rights.

9. ACCEPTABLE USE POLICY

You agree not to:

  • Use the Platform for illegal purposes
  • Harass or abuse other users
  • Attempt to scrape, hack, or reverse-engineer the Platform
  • Resell or redistribute content without permission

10. LIMITATION OF LIABILITY

The Platform is provided "AS-IS". We make no warranties regarding accuracy or reliability.

To the maximum extent permitted by law, d33ply shall not be liable for indirect, incidental, or consequential damages.
